RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JASPER, ALABAMA WHEREAS, the City Council of the City of Jasper, Alabama, has been presented with a Declaration of Vacation of a 20' North / South alley lying West of 3rd Avenue between Marion Avenue and 13th Street West in the City of Jasper, executed by the following persons, representing all of the landowners abutting said portion of said street sought to be vacated, in accordance with 23-4-20, Code of Alabama (1975); and WHEREAS, the City Council of the City of Jasper, Alabama, has scheduled a public hearing, held at a regularly scheduled meeting of the City Council of the City of Jasper, Alabama, prior to taking any final action on the aforementioned Declaration, and has published notice thereof, containing a description of said street or alley sought to be vacated in the Daily Mountain Eagle for four consecutive weeks, and has posted notice of the same upon a bulletin board in the Walker County Courthouse, and has served by U.S. Mail all abutting landowners and any entity known to have facilities or equipment within said public right-of-way; and WHEREAS, The City Council of the City of Jasper, Alabama, has conducted said public hearing, as advertised, and has permitted to be heard all citizens alleging to be affected by the proposed vacation, either in person or written objection; and WHEREAS, The proposed vacation shall not deprive other property owners of any right they may have to convenient and reasonable means of ingress and egress to and from their property, (and if that right is not afforded by the remaining streets and alleys, another street or alley affording that right has been dedicated). BE IT THEREFORE RESOLVED, as follows: 1. The street sought to be vacated is described as follows: A 20' North / South alley lying West of 3rd Avenue between Marion Avenue and 13th Street West, City of Jasper, County of Walker, State of Alabama. 2. The owner or owners of the abutting lots or parcels of land to such street are: Roger and Pam Burleson, David and Elizabeth Owens, Eric and Lezlee Peters, Shane and Elizabeth Weber, Doug Channel (Floydean Properties, LLC) and Anne Burleson Johnsey. 3. The owner or owners of such other lots or parcels which shall be cut off from access over some reasonable or convenient way by the proposed vacation are: N/A 4. It is in the best interest of the public that said street, alley or highway, or portion thereof, as described above, be vacated. 5. This Resolution shall be filed in the Probate Court of Walker County, Alabama. 6. Notice of this action shall be published once in the Daily Mountain Eagle no later than 14 days after the adoption of the Resolution. ADOPTED this the 18th day of December, 2012.
